1) Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the MGO Radio App mobile/desktop application and related services (collectively, the “Service”), operated by Global Outreach Mission, Inc. DBA MissionGO (“Company,” “we,” “us”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy available at https://www.missiongo.org/privacy-policy. If you do not agree, do not use the Service.

2) Eligibility

You must be at least 18 years old to use the Service, or the age of digital consent in your jurisdiction. If you are under the age of majority, you may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

3) Account Registration & Security

Some features may require an account. You agree to:

• Provide accurate and complete information;

• Keep your credentials confidential and secure;

• Be responsible for all activities under your account; and

• Notify us immediately of any unauthorized use or security breach.

We may refuse, suspend, or terminate accounts at our discretion where we have legitimate reasons (e.g., misuse, fraud, violation of these Terms).

4) The Service: Streaming-Only Access

The Service provides streaming access to music, talk radio, and other audio programs. No ownership rights are transferred. Unless expressly enabled:

• No Downloads: You may not download, copy, or reproduce streams (except as explicitly permitted by the app, e.g., temporary buffering).

• No Public Performance: The Service is for personal, non-commercial use only. Public performance, re-broadcast, or commercial use requires express written permission and, where applicable, additional public performance licenses.

• Geo-Availability: Content availability may vary by territory due to licensing restrictions and may change at any time.

5) Content & Intellectual Property

All content, including audio, metadata, artwork, logos, text, software, and trademarks (collectively, “Content”) is owned by us or our licensors and is protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Content strictly in accordance with these Terms.

You must not:

• Remove or alter copyright, trademark, or other proprietary notices;

• Circumvent DRM or any technical protection measures;

• Reverse engineer, decompile, or attempt to derive source code, except to the extent allowed by applicable law.

6) Third-Party Streams & Stations

Some stations, programs, or feeds are provided by third parties. We do not control and are not responsible for third-party content, availability, or accuracy. Your interactions with third-party providers (including their terms and privacy policies) are solely between you and those providers.

7) Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or to violate laws or regulations;

• Record, capture, retransmit, rebroadcast, or distribute streams without authorization;

• Use bots, scrapers, or automated means to access the Service, or impose an unreasonable load;

• Interfere with or disrupt the Service, or attempt to bypass access or security controls;

• Misrepresent your identity or affiliation.

8) Advertising & Sponsorships

The Service may contain ads, sponsorships, or promotions. Your interactions with advertisers are solely between you and the advertiser. We are not responsible for any loss or damage arising from such dealings.

9) Data & Privacy

Your use of the Service is also governed by our Privacy Policy at https://www.missiongo.org/privacy-policy, which explains what data we collect, how we use it, retention, sharing, cookies/SDKs, analytics, and your choices. By using the Service, you consent to our data practices described there.

10) Network & Device Requirements

You are responsible for obtaining compatible devices, internet access, and data plans. Streaming can consume substantial data. We do not guarantee uninterrupted or error-free operation and may suspend or limit access for maintenance, security, or legal reasons.

11) No Emergency Services

The Service is not a replacement for emergency services and does not connect you to emergency responders.

13) Termination

We may suspend or terminate your access if you violate these Terms, if required by law, or for legitimate business reasons. You may stop using the Service at any time. Upon termination, the rights granted to you under these Terms will cease, but Sections intended to survive (e.g., IP, Disclaimers, Limitation of Liability, Indemnity, Governing Law) will remain in effect.

14) Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR AVAILABLE AT ALL TIMES.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE [12] MONTHS PRECEDING THE CLAIM (OR, IF NO AMOUNTS WERE PAID, $20).

Some jurisdictions do not allow certain limitations; in such cases, portions of this section may not apply.

16) Indemnification

You agree to indemnify and hold harmless Global Outreach Mission, DBA MissionGO, its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

17) Changes to the Service and Terms

We may modify or discontinue parts of the Service. We may also update these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app notice or email) and indicate the “Last Updated” date. Your continued use after changes become effective constitutes acceptance.

18) Governing Law; Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles.

19) Export & Sanctions

You agree to comply with all applicable export control and sanctions laws and not to use the Service in or for the benefit of embargoed countries or prohibited parties.

20) Children’s Privacy

The Service is not directed to children under 13 and we do not knowingly collect personal data from children without appropriate parental consent as required by law (e.g., COPPA/UK GDPR/EU GDPR-K). If you believe a child has provided personal data, contact us, and we will take appropriate steps.

21) Open-Source & Third-Party Software Notices

The Service may include open-source components or third-party libraries subject to their own licenses. Those licenses govern the use of those components.
